Dukes, said to be under the influence of drugs, apparently called the police himself a half-hour after midnight. When the police arrived and made moves to subdue him, he dashed out of his house, then physically struggled with officers--while still calling for help from the police. He was pepper-sprayed twice, lost consciousness, and died. The family arrived at a $500K settlement with the city.
