Deadly force
Within hours after breaking away from a hospitalization, mentally ill Schorr was visited by two local police, to retrieve him for an involuntary commitment. There was a violent struggle, both officers were wounded, and Schorr was fatally shot. The family filed suit under a novel theory that a fatal police shooting violated ADA. This was upheld by the Third Circuit in 2003.
