Hambric crashed a stolen automobile and was fleeing when a Winston-Salem bicycle patrol officer attempted to apprehend him. Hambric grabbed the officers baton and brandished it at the officer. He refused to drop the baton and advanced on the officer, who shot and killed Hambric.
