Officer Brian R McKenzie struck pedestrian Justin D. Nealon with his marked cruiser as Nealon crossed an intersection at around 3 a.m. Nealon died from his injuries one week later. McKenzie was on a cell phone when the crash occurred, and an attorney for Nealon's family contended that McKenzie did not have his headlights on.
