Officer Ashley Kelley responded to a call about a man hitting random cars with a flag pole around 5:30 p.m. She encountered Jose S. Banda lying down on the median when she arrived. As the officer approached Banda, Banda rushed her, tackled her to the ground and put the officer in a choke hold. The officer broke free and ordered Banda to stop. He continued to advance on her, and she shot and killed Banda.
