Deadly force

Police report that while responding to a nearby fight, they pursued a man into Garay's backyard, and that they saw Garay with a gun in his waistband. They report that during a struggle on the porch, they allege that Garay pointed his gun at Officer Michael Colasardo, who shot him twice. The family claims that Garay was shot inside the home and did not point his gun at the police, and that a family member was tasered. The tasered family member and Garay's family were awarded financial damages in 2016
