Trapped in a stolen minivan in heavy traffic, Lagattuta rammed the van back and forth in an attempt to escape, while six NYPD officers surrounded hm and tried to extract him. The driver was shot, apparently accidentally, by one of the officers while hammering on the van window with his pistol. Lagattuta was then handcuffed, and the keys to the handcuffs then lost, which delayed medical attention. One of four fatal police shootings in the first two days of 2003.
