DeVito was the blameless victim of a head-on auto crash with an eight-year veteran of the NYPD, driving full-speed southbound in the northbound lanes of the state Thruway. The officer also died. Contrary to initial police reports, the officer had a blood-alcohol level of 0.21 percent at 7 a.m. and on his way to work.
