Hernan Jaramillo, 51, reportedly began making strange noises in his bedroom in the home he shared with his sister. His sister thought he was being assaulted and called the police. Police officers attempted to gain control of Jaramillo to take him to a psychiatric evaluation but he struggled and resisted being placed in the police cruiser. According to his family's successful wrongful death lawsuit, Jaramillo was placed face down on the ground with one officer's knee in his back and four officers adding their weight to stop him from struggling. Jaramillo became unresponsive and never regained consciousness. The city of Oakland paid $450,000 to settle the wrongful death lawsuit with his family, without admitting any criminal wrongdoing.
