Deadly force

Police were pursuing a driver who had fled on foot from his other when Trooper Donald F. Gregory, 34, came upon Donal Theilen. Gregory said he repeatedly gave Theilen orders, which he would not follow. Theilen allegedly indicated that he had a gun, and he began chasing Gregory. Gregory said he fired four rounds at the pursuing Theilen, who was struck with one bullet in the left hip. Theilen died at the scene. A pistol was found at the scene near Theilen.
