Las Vegas police sergeant and his team were surveilling murder suspect Charles Whaley and were going to serve him with a "notice of intent to seek indictment" by the Clark County District Attorney's office. Whaley got into the back of a car and drove away and police pulled him over. He got out of the car and began running. The sergeant chased him to a chain link fence in between two homes, where Whaley was crouching and had his hands around his waistband. Robison believed Whaley was reaching for a firearm and he fired several times. The sergeant again asked to see his hands, and he didn't move so he fired again. When police went up to Whaley they saw he was unarmed.
