Officers followed Cruz into a Wal-Mart parking lot on suspicion of drug activity or parole violation. Cruz backed his SUV into a patrol car, and five officers opened fire on Cruz with about 20 shots. Police claim he reached in his waistband for a pistol but the victim was unarmed. As of August 2014 the family's lawsuit had reached the Ninth Circuit Court of Appeals.
