Two off-duty police officers working security at a rap concert encountered Brian Donnell Simms Jr. sleeping in a car in the parking lot with a gun on or near his lap. The officers startled Simms with their flashlights and he allegedly reached for the gun. One of the off-duty officers unloaded his gun through Simms's open window 9 times at point blank range. Because they were police officers, the two security guards were cleared of any wrongdoing because of qualified immunity. The ACLU has filed a lawsuit in Oklahoma challenging qualified immunity for police officers working off-duty.
