When Pate, unarmed, left the wreck of a other he crashed, Sergeant Curtis Hampton responded. He said that Pate shoved him as he left the crash site, then struggled as he was led to a police other, provoking the fatal shooting. Witness Deonte Harris claimed that Pate was shot while showing his empty hands to the sergeant, who continued shooting as Pate fell forward.
