Officers Steven C. Ward and Matt Carman were parked in an unmarked car as part of a stakeout of another home when Ousa approached. Police said the officers opened fire after they saw Ousa brandish what they thought was a weapon but was actually a flashlight. Ousa's family said the officers took the flashlight from their home and planted it on Ousa to justify the shooting. The family also said Ward was on steroids, and Ward later resigned amidst a drug investigation against him. West Valley City settled a lawsuit with Ousa's family for $450,000.
