Krzyzak was a pedestrian fatally struck by a car driven by Jose Maldonado which was being pursued by NYPD in a high-speed chase. When struck by the car going at least 70 MPH Krzyzak flew 165 feet through the air, almost a city block. Despite a wealth of eyewitness accounts the police denied that any pursuit happened.
