Rivas was pursued by Southern Ute and Ignacio police departments westbound on County Road 318 after he almost backed into another other in Ignacio, according to a Colorado State Patrol report. Police stopped the pursuit at mile marker 13 and lost sight of Rivas when he was about two miles ahead of their vehicles. When they caught up with the other, the 1996 blue Cadillac Eldorado was on fire with Rivas trapped inside trying to get out of the car. He was overcome by the fire and pronounced dead at the scene. The spot Rivas drove off the road was at mile marker 7.
