Deadly force

Cop returning home from shift very late at night (off duty at the time of the shooting) and sees man in nearby construction. Officer approaches man, identifies himself as a police officer, sees something in the hand of the man, which turned out to be a screwdriver. Officer fired several shots (the office shot himself first before shooting the victim). The victim turned out to be homeless.
