About 8:45 p.m., police were called on a report of several people fighting in the road, police said. An officer encountered Birendra Thakuri and his brother. Unbeknownst to the officer, Thakuri was bipolar and suffering a mental breakdown and his brother was trying to keep him under control. The unarmed Thakuri advanced on the officer two times, the second time the officer shot and killed him. Although the DA declined to file criminal charges against the officer, the mother has filed a federal wrongful death lawsuit.
