Officers responded at about 3:05 a.m. to a call of a man with a gun. An officer encountered Rafael "Pito" Rivera with a handgun. The officer engaged in a foot pursuit that covered about a half a block and ended in a parking lot in the 400 block of Plymouth. Rivera reportedly did not comply to orders by the officer to put the gun down, and the officer shot and killed him. A video of the incident reportedly shows Rivera running away from the officer when he is shot. Rivera's family has filed a wrongful death civil lawsuit.
