Gillie Thurby was wanted on a felony failure-to-appear warrant out of Boulder County. He faced a number of charges related to sexual assault on a child and child pornography. Three officers, one in plain clothes and two in uniform, encountered Thurby at a fire pit outside a movie theater. When officer moved to physically arrest Thurby, he stood up and reached for a handgun in his waistband. One officer tasered Thurby, who fell flat on his back with the gun in his hand. When Thurby allegedly fingered the trigger on the gun, one officer shot and killed Thurby.
